The open work permit deadline for TR-to-PR pathway applicants (who applied in 2021) has been extended to December 31, 2026, allowing eligible applicants and their families to continue working for any employer while awaiting a PR decision.
As of April 1, 2026, employers hiring low-wage foreign workers must advertise job positions for 8 consecutive weeks (up from 4) before submitting an LMIA, with additional mandatory youth recruitment requirements and restrictions on processing in high-unemployment census metropolitan areas.
Effective July 17, 2026, ESDC updated provincial and territorial wage thresholds that determine whether a position is classified as high-wage or low-wage under the TFWP, and updated the list of restricted census metropolitan areas where low-wage LMIA applications will not be processed.
What You Should Do
- If you submitted a PR application in 2021 under the TR-to-PR pathway and are still waiting for a decision, apply for an open work permit before December 31, 2026 via the IRCC portal at canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/tr-pr-pathway/open-work-permit.html. Confirm you meet all 5 eligibility requirements listed on that page before applying.
- Employers planning to hire low-wage foreign workers: begin your job advertising immediately, as you must now advertise the position for at least 8 consecutive weeks within the 3 months before submitting your LMIA application to ESDC. Keep detailed records of all advertising activity to include in your LMIA submission.
- Employers and foreign workers in low-wage TFWP positions: check the updated July 17, 2026 provincial/territorial wage thresholds at settler.ca/english/canada-updates-tfwp-wage-and-lmia-rules-for-2026 to confirm whether your role is now classified as high-wage or low-wage, as this affects LMIA processing requirements.
- Employers in census metropolitan areas with unemployment at or above 6%: review the updated restricted CMA list (effective July 17, 2026) at settler.ca/english/canada-updates-tfwp-wage-and-lmia-rules-for-2026 to confirm whether your region is subject to the LMIA refusal-to-process measure before submitting a low-wage LMIA application.
